Brand name registration in Mumbai
A brand name is registered as a word mark, which protects the name in any font, colour or logo. In a city where a new restaurant or label can be copied within weeks, it is usually the first thing to file.
Names fall on a scale. Coined words ("Zorvo") and arbitrary words used out of context ("Monsoon" for shoes) are strongest. Suggestive names hint at a quality and usually pass. Descriptive names such as "Fresh Bakes" or "Mumbai Tailors" tell buyers what the product is or where it comes from, and the examiner will object under section 9. Common surnames and devotional words face crowded registers.
- Taglines can be registered if they are not purely laudatory. "Quality you can trust" will not pass; a distinctive line can.
- A range of names under one house brand: register the house mark first, then the sub-brands that carry real sales.
- Logo and name separately: the word mark protects the name; the logo mark protects the artwork.
Choose the classes before you file. A fashion label in Kala Ghoda sells in class 25, may add class 35 for its online store, and class 18 if it sells bags.
Do you need a trademark agent in Mumbai?
No. The Trade Marks Act lets an applicant file in person. A registered trade marks agent or an advocate is worth having when the search shows near conflicts, when an examination report arrives, or when the matter goes to a hearing or opposition.
When you compare trademark consultants in Mumbai, ask four things:
- Is the person filing a registered trade marks agent or an advocate? The agent's name appears on IP India's list of agents.
- Will they give you a written search report before filing?
- Do they separate the government fee from their professional fee, in writing?
- Do they promise registration? Nobody can: the examiner and any opponent decide.
Our office is in Vashi, across the harbour. Clients in central Mumbai (Dadar, Parel, Lower Parel), the western suburbs from Vile Parle to Borivali and the eastern suburbs work with us by email and video call, and visit when it suits them.
How does trademark registration work in Mumbai?
Day 1–2
Search and class advice
We search identical and phonetically similar marks in your classes, including pending applications and device marks. Mumbai’s registers for restaurants, apparel and jewellery are crowded, so the report ranks each conflict as low, medium or high risk.
Before filing
Paperwork and authorisation
We check the goods description against your invoices or menu and prepare Form TM-48 for signature, so the application clears the formalities check first time.
Filing day
Filing with the Trade Marks Registry, Mumbai
We file Form TM-A online on IP India. Because the principal place of business is in Maharashtra, the application is handled by the Trade Marks Registry, Mumbai. You receive the application number the same day and may use ™ with the mark.
Weeks to months
Examination
An examiner checks the mark against the absolute grounds (section 9) and earlier marks (section 11) and issues an examination report. Reports are published on the IP India status page; we watch it and tell you.
If raised
Objection reply and hearing
Most objections are answered in writing. If the registry lists a show-cause hearing we attend it, by video conference or at Antop Hill, and send you a note of what was decided.
After acceptance
Journal and opposition window
An accepted mark is advertised in the Trade Marks Journal. Any person may oppose it within four months of advertisement.
Unopposed
Registration certificate
The mark is registered and the certificate is issued online. Registration lasts ten years from the application date and renews with Form TM-R.
What documents does a Mumbai business need?
Proof of first use carries weight in Mumbai, where a rival restaurant or label may claim earlier use, so keep the oldest dated menu, invoice or label. Wholesale-market partnerships file with the deed.
Every applicant
- The mark: the word, or a clear JPG of the logo as it will be used
- The goods or services you sell or plan to sell
- Applicant name, address and legal entity
- Form TM-48 authorising the agent, which we prepare for signature
- If the mark is already in use: an affidavit of first use in India, with dated evidence of use
By applicant type
- Individual or proprietor: identity and address proof
- Startup: DPIIT recognition certificate, for the lower fee
- Small enterprise: Udyam registration certificate, for the lower fee
- Company or LLP: certificate of incorporation
- Partnership firm: partnership deed
What are the government fees?
Government fees are paid to IP India per class when we file. A Mumbai proprietorship, startup or Udyam-registered MSME pays the lower rate on proof; other private limited companies and LLPs pay the standard rate.

Trademark registration in Mumbai: questions
Where is the trademark registration office in Mumbai?
The Trade Marks Registry, Mumbai is at Boudhik Sampada Bhavan, near Antop Hill Post Office, S.M. Road, Antop Hill, Mumbai 400037. Applications are filed online, so you do not need to visit it.
Can I register a restaurant name in Mumbai if a café elsewhere in India uses it?
Possibly, but not safely without a search. If the other café registered first or used the name earlier, it can oppose your application or sue for passing off. We check the register and common-law use before you invest in signage.
Should a Zaveri Bazaar jeweller register the shop name or the family name?
Usually the shop name as used on hallmarked boxes and invoices, in class 14 for jewellery and class 35 for retail services. A bare family name is harder to register because other jewellers may share it.
I run a production house in Andheri. Which classes should I file in?
Class 41 for production and entertainment services, class 9 if you sell downloadable films or music, and class 38 only if you operate a streaming or broadcast service yourself. The films themselves need copyright registration.
Is a name with "Bombay" or "Mumbai" in it registrable?
Rarely on its own, because it describes origin. "Bombay" plus a distinctive word or logo can be registered, usually with a disclaimer of the city name.
Do I need a separate application for my logo?
Yes, if you want the artwork protected. File the name as a word mark first; file the logo once it is final. Many Mumbai businesses file both on the same day.
Can you meet us in Mumbai?
Our only office is in Vashi, Navi Mumbai. Most Mumbai clients work with us by email and video call; you are welcome at the Vashi office by appointment.
