Trademark Registration in Delhi
For Delhi, Gurugram, Noida, Ghaziabad and Faridabad businesses.
Delhi applications are examined by the Trade Marks Registry, New Delhi, which handles Delhi, Haryana, Punjab, Uttar Pradesh and the other northern states. The registry is set by the applicant’s principal place of business, not the agent’s, so our filing from Vashi still goes to Delhi. With no objection or opposition, registration commonly takes about a year.

Can a firm in Navi Mumbai file for a Delhi business?
Yes. Trademark applications are filed online on IP India from anywhere in the country, and the registry is chosen by the applicant's principal place of business, not by the agent's office. A Delhi company that instructs us is examined by the Delhi registry, exactly as if it had filed itself.
What changes is how we work together: documents travel as scans, the authorisation is signed and scanned, and discussions happen on video calls. Show-cause hearings before the Delhi registry are attended by us, generally by video conference.
Delhi's markets also shape the advice:
- Sweets, namkeen and spices (class 30) are dominated by family names, and family businesses that split often end up disputing the shared name. Put ownership in writing, through a family settlement or an assignment, before anyone files.
- Apparel from Okhla and Gandhi Nagar (class 25) faces thousands of earlier marks; a coined word survives where a common English word does not.
- Coaching institutes need class 41, and class 16 for printed study material or class 9 for downloadable lectures.
- Restaurant chains (class 43) should file before opening a second outlet in another NCR state.
How does registration work for a Delhi business?
Day 1–2
Search and class advice
We search the national register for identical and similar marks, with extra care in classes 25, 30 and 43 where Delhi’s registers are dense. The report lists each conflict, its owner and its status.
Before filing
Paperwork and authorisation
Scans travel by email and Form TM-48 is signed and scanned back. We state your principal place of business on the form, since that is what sends the application to the Delhi registry.
Filing day
Filing with the Trade Marks Registry, New Delhi
We file Form TM-A online on IP India. Because the principal place of business is in Delhi, the application is handled by the Trade Marks Registry, New Delhi. You receive the application number the same day and may use ™ with the mark.
Weeks to months
Examination
An examiner checks the mark against the absolute grounds (section 9) and earlier marks (section 11) and issues an examination report. Reports are published on the IP India status page; we watch it and tell you.
If raised
Objection reply and hearing
Objections from the Delhi registry are answered in writing. If a show-cause hearing is listed, we attend it for you, usually by video, and report the outcome the same day.
After acceptance
Journal and opposition window
An accepted mark is advertised in the Trade Marks Journal. Any person may oppose it within four months of advertisement.
Unopposed
Registration certificate
The mark is registered and the certificate is issued online. Registration lasts ten years from the application date and renews with Form TM-R.
What documents does a Delhi business need?
A family business adds any settlement, partition deed or assignment that says who owns the name; without it, the application invites opposition from relatives. NCR companies in Gurugram or Noida send the same papers as those in Delhi.
Every applicant
- The mark: the word, or a clear JPG of the logo as it will be used
- The goods or services you sell or plan to sell
- Applicant name, address and legal entity
- Form TM-48 authorising the agent, which we prepare for signature
- If the mark is already in use: an affidavit of first use in India, with dated evidence of use
By applicant type
- Individual or proprietor: identity and address proof
- Startup: DPIIT recognition certificate, for the lower fee
- Small enterprise: Udyam registration certificate, for the lower fee
- Company or LLP: certificate of incorporation
- Partnership firm: partnership deed
What are the government fees?
Government fees are the same at every registry and are paid per class. Delhi proprietors, startups and Udyam-registered MSMEs pay the lower rate on proof; other companies and LLPs pay the standard rate.

Trademark registration in Delhi: questions
Which Trade Marks Registry handles Delhi and the NCR?
The Trade Marks Registry, New Delhi. It covers Delhi, Haryana and Uttar Pradesh, so Gurugram, Faridabad, Noida and Ghaziabad all go there too.
If our agent is in Navi Mumbai, will our application move to Mumbai?
No. The registry follows the applicant’s principal place of business in India. A Delhi applicant stays with the Delhi registry whoever files.
Our family sweet shop has split into two businesses. Who owns the name?
It depends on the agreements between the family members, earlier registrations and who has used the name. Settle ownership in writing first; filing without that invites an opposition.
Which classes does a coaching institute in Mukherjee Nagar need?
Class 41 for coaching and education services. Add class 16 for printed books and notes and class 9 for an app or downloadable lectures.
Will hearings on my Delhi application take place in Delhi?
Hearings are listed by the Delhi registry and are usually held by video conference. We attend for you; you do not need to be present.
Can a Delhi garment exporter extend this filing abroad?
Yes. The Indian application or registration can be the base for a Madrid Protocol filing that designates other countries.
