Trademark Registration in Bengaluru (Bangalore)
For Bengaluru (Bangalore) product companies, fintechs and consumer brands.
Bengaluru applications are examined by the Trade Marks Registry, Chennai, which handles Karnataka, Tamil Nadu, Kerala, Andhra Pradesh, Telangana, Puducherry and Lakshadweep; Karnataka has no trade marks office of its own. Which Trade Marks Registry handles Bengaluru?
The Trade Marks Registry, Chennai, in the Intellectual Property Office Building at Guindy. All five southern states share it, so a Bengaluru company is examined in Chennai, not in Mumbai or Delhi.

What should a Bengaluru startup file before launch?
File the product name before it appears on an app store, a pitch deck or a funding announcement. Once a name is public, anyone can file it first, and a rebrand after launch costs far more than a search.
Start with the right classes. Downloadable apps and software are class 9; hosted SaaS and platforms are class 42; payments, lending and insurance products are class 36. A fintech app usually needs all three.
Pick a name that can be owned. Ordinary English words work when they have nothing to do with the product, the way "Apple" has nothing to do with computers. Words that describe what the product does, such as "QuickPay", "SmartHR" or "CloudBooks", draw objections and leave you with a weak mark even if they pass.
File in the company's name. Investors check that the brand belongs to the company. If a founder filed personally, assign it to the company before the round.
Plan abroad from day one. An Indian application can serve as the base for a Madrid Protocol filing, or support direct filings such as in the USA, within six months while keeping the Indian priority date.
Consumer brands follow the same logic. Craft beer is class 32, not 33; garments from Peenya units are class 25.
How does a Bengaluru company register a trademark?
Day 1–2
Search and class advice
We search the Indian register for identical and similar marks in classes 9, 35, 36 and 42 as needed, and flag clashes we can see on app stores. Tech names are often near-duplicates, so the report scores each one.
Before filing
Paperwork and authorisation
An authorised director signs Form TM-48 and returns a scan. If the app is already live, the launch date and store listing support the claimed date of first use.
Filing day
Filing with the Trade Marks Registry, Chennai
We file Form TM-A online on IP India. Because the principal place of business is in Karnataka, the application is handled by the Trade Marks Registry, Chennai. You receive the application number the same day and may use ™ with the mark.
Weeks to months
Examination
An examiner checks the mark against the absolute grounds (section 9) and earlier marks (section 11) and issues an examination report. Reports are published on the IP India status page; we watch it and tell you.
If raised
Objection reply and hearing
Examination reports from the Chennai registry are answered in writing, often with evidence of use such as downloads, revenue or press. If a hearing is listed, we attend it by video conference.
After acceptance
Journal and opposition window
An accepted mark is advertised in the Trade Marks Journal. Any person may oppose it within four months of advertisement.
Unopposed
Registration certificate
The mark is registered and the certificate is issued online. Registration lasts ten years from the application date and renews with Form TM-R.
What documents does a Bengaluru business need?
For a Bengaluru startup, the DPIIT recognition certificate brings the lower fee, and the application is filed in the company’s name. If a founder filed personally, add the signed assignment to the company.
Every applicant
- The mark: the word, or a clear JPG of the logo as it will be used
- The goods or services you sell or plan to sell
- Applicant name, address and legal entity
- Form TM-48 authorising the agent, which we prepare for signature
- If the mark is already in use: an affidavit of first use in India, with dated evidence of use
By applicant type
- Individual or proprietor: identity and address proof
- Startup: DPIIT recognition certificate, for the lower fee
- Small enterprise: Udyam registration certificate, for the lower fee
- Company or LLP: certificate of incorporation
- Partnership firm: partnership deed
What are the government fees?
The fee is charged per class and is the same at every registry. DPIIT-recognised startups and Udyam-registered MSMEs in Bengaluru pay the lower rate; other companies pay the standard rate.

Trademark registration in Bengaluru: questions
Why is a Bengaluru application handled in Chennai?
IP India has trade marks offices in five cities only. The Chennai office covers all the southern states, including Karnataka, so Bengaluru applications are examined there.
Our app’s name is an ordinary English word. Can we register it?
Yes, if the word has no link to what the app does. If it describes the function or a quality of the product, expect an objection and a weaker mark.
Is craft beer class 32 or class 33?
Beer is class 32. Wine and spirits are class 33. A brewery that also sells merchandise may add class 25 for apparel.
Should we file in the USA before India?
Usually India first. The Indian application gives you a priority date, and you have six months to file abroad, through Madrid or directly, while claiming it.
Can a Bengaluru fintech use "Pay" in its name?
It can use it, but cannot own it. "Pay" is descriptive for payment services, so protection rests on the rest of the name. Choose a distinctive element and expect a disclaimer of "Pay".
Will our hearing take place in Chennai?
The Chennai registry lists the hearing, and hearings are generally held by video conference. We attend for you.
