What is the trademark fee for a proprietorship, MSME, startup or company?
The Form TM-A fee depends on who the applicant is. Only three categories pay the lower rate: an individual, a startup and a small enterprise, as rule 2 of the Trade Marks Rules, 2017 defines them. Everything else pays the standard rate.
| Applicant | Rate | TM-A, e-filing, per class | TM-A, paper, per class | Proof filed with the application |
|---|---|---|---|---|
| Individual or sole proprietorship | Lower | ₹4,500 | ₹5,000 | Identity and address proof; the application is in the proprietor’s own name |
| Micro, small or medium enterprise (any legal form) | Lower | ₹4,500 | ₹5,000 | Udyam registration certificate |
| DPIIT-recognised startup | Lower | ₹4,500 | ₹5,000 | DPIIT recognition certificate (a foreign startup files a declaration that it meets the Startup India criteria) |
| Private limited or public company | Standard, unless it is a startup or has Udyam registration | ₹9,000 | ₹10,000 | Certificate of incorporation; Udyam or DPIIT certificate if claiming the lower rate |
| LLP | Standard, unless it is a startup or has Udyam registration | ₹9,000 | ₹10,000 | LLP incorporation certificate; Udyam or DPIIT certificate if claiming the lower rate |
| Partnership firm | Standard, unless it has Udyam registration | ₹9,000 | ₹10,000 | Partnership deed; Udyam certificate if claiming the lower rate |
| Trust, society, government body, foreign company | Standard | ₹9,000 | ₹10,000 | Constitution documents; power of attorney on Form TM-48 |
Fees from the Trade Marks Rules, 2017, First Schedule, entry 1, as shown on the IP India Forms & Official Fees page, checked on 15 October 2026. Statutory fees only; our professional fee is quoted separately in writing. The fee is for each class and each mark.
The Udyam and DPIIT rule, in one paragraph
A company, LLP or firm pays the lower fee only if it is a "startup" or a "small enterprise" under rule 2(1) of the Trade Marks Rules, 2017. A startup is an entity recognised under the Startup India initiative, which is why the DPIIT certificate is the proof. A small enterprise is one whose investment in plant and machinery (or equipment, for services) does not exceed the limit the MSME Development Act, 2006 sets for a medium enterprise, which is why the Udyam certificate is the proof. File the certificate with the application: rule 10(5) treats a document filed with an insufficient fee as not filed.

Who qualifies for the lower trademark fee?
The lower fee in the First Schedule applies to three kinds of applicant:
- Individuals. A natural person applying in their own name, including a sole proprietor trading under a business name.
- Startups. An entity in India recognised as a startup by the competent authority under the Startup India initiative, shown by the DPIIT recognition certificate. A foreign entity qualifies if it meets the Startup India turnover and age criteria and files a declaration to that effect.
- Small enterprises. Despite the name, rule 2 uses the MSME law's medium enterprise investment limit, so micro, small and medium enterprises can all qualify. The Udyam registration certificate is the usual proof.
Every other applicant pays the higher fee: companies, LLPs, partnership firms, trusts, societies, government bodies and foreign applicants that are not a startup or a small enterprise in this sense. In a joint application, confirm before filing that the lower fee is available for the combination of applicants.
How much does a typical trademark filing cost in government fees?
Worked examples using the e-filing fees above. They exclude professional fees.

| Private limited company with Udyam registration, one mark, Classes 9 and 42 | 1 mark × 2 classes × ₹4,500 | ₹9,000 |
| Private limited company without Udyam or DPIIT, one mark, Classes 9 and 42 | 1 mark × 2 classes × ₹9,000 | ₹18,000 |
| Company, one mark, one class, expedited examination | ₹9,000 + ₹40,000 | ₹49,000 |
| Renewal of one registration in three classes | 3 classes × ₹9,000 | ₹27,000 |

Is the trademark fee refundable?
As a rule, no. The fee pays for examining the application, and nothing in the Trade Marks Rules, 2017 returns it because an application is objected to, refused, abandoned or withdrawn.
There is one narrow statutory exception, in section 133 of the Trade Marks Act, 1999:
- Before filing, you ask the Registrar for preliminary advice on whether the mark is distinctive (Form TM-M).
- The advice is favourable, and you file the application within three months of it.
- The Registrar then objects that the mark is not distinctive after all.
- You give written notice of withdrawal within one month of receiving the examination report (rule 35).
In that case the fee paid on filing the application is repaid. The exception does not cover objections on other grounds, such as an earlier conflicting mark under section 11. A search before filing is the practical way to avoid paying for an application that cannot succeed.
Which trademark costs are not government fees?
The First Schedule covers only what the Registry charges. Your total cost may also include:
- Professional fees for the search, drafting, filing, replies and hearings, which we quote in writing before starting.
- Stamp duty on documents such as a deed of assignment, set by state law.
- Evidence preparation, such as a chartered accountant’s certificate of sales figures for an objection reply or opposition.
The First Schedule lists no fee for filing a reply to an examination report or for attending a show cause hearing. Requests made along the way, such as an amendment or a review, are filed on Form TM-M with the fees shown above.
Trademark fee FAQs
Is the trademark fee charged per class or per application?
Per class and per mark. A single application can cover several classes, but the TM-A fee is multiplied by the number of classes. A word mark and a logo are separate marks, each with its own fee.
Do I pay again when the trademark is registered?
No. There is no separate registration or certificate fee once the application is accepted and unopposed. The next statutory fee is the renewal fee after 10 years.
Is the government fee refunded if my application is refused?
Generally no. The only refund in the Act is the narrow section 133 case explained above, where favourable preliminary advice on distinctiveness is followed by a distinctiveness objection and a withdrawal within one month.
Can a private limited company pay the lower fee?
Only if it is a DPIIT-recognised startup or has Udyam registration as a micro, small or medium enterprise, and it files proof of that status. Otherwise the company pays the higher fee.
Can I get the ₹4,500 fee with an Udyam certificate?
Yes, if the certificate shows the applicant itself, in the same name as on the application, and it is filed with the application. The Udyam certificate of a related business, or of a director, does not qualify the company.
Does a sole proprietor need Udyam registration to pay the lower fee?
No. A sole proprietor applies as an individual, which is already a lower-fee category. Udyam registration matters for companies, LLPs and partnership firms.
How often are trademark fees revised?
Rarely. The current schedule came in with the Trade Marks Rules, 2017. We recheck the amounts against IP India each time this page is updated, and show the date checked under each table.
Are taxes added to the government fee?
The statutory fee is paid to the Registry as listed in the schedule. GST applies to professional fees, not to the government fee itself.
