How should BKC companies structure their trademark filings?

Who owns the mark. When the brand belongs to a foreign group, the parent usually owns the Indian registration and licenses it to the Indian subsidiary. Under the Trade Marks Act a licence does not have to be recorded with the registry, but a written licence that controls quality protects the mark and makes enforcement simpler. Recording the licensee as a registered user remains available.

Financial products. Banking, broking, lending and insurance services are class 36. A fintech product also needs class 9 for the app and class 42 for the platform. Words such as "Pay", "Capital", "Wealth" and "Fin" are crowded and descriptive; the distinctive element carries the protection.

Law and consulting firms. Legal services are class 45 and consulting class 35. Professional rules limit how lawyers advertise, but they do not stop a firm registering its name.

Diamond traders in the Bharat Diamond Bourse register house marks and named cuts in class 14. A name for a cut can be a trademark; the shape of the cut itself is not protected by the name.

Portfolios of this kind need a renewal calendar and a watch on new applications, so that conflicting marks are opposed within the four-month window.
