Formalities Chk Pass means the Trade Marks Registry has checked the formal details of your application, such as the applicant, the form, the fee and the authorisation, and found nothing missing. No action is needed. The next status is usually Marked for Exam, when the application waits for an examiner. There is no fixed time limit for that step.

What does Formalities Chk Pass mean?
"Chk" is short for check. After a trademark application is filed on Form TM-A and given its number, the Registry runs a formalities check: a review of the paperwork, not of the mark itself. Pass means the check found no deficiency.
The formalities check is separate from examination. It does not look at whether your brand is distinctive or whether an earlier mark conflicts with it. Those questions come later, when an examiner takes up the file and tests the mark under section 9 (absolute grounds) and section 11 (relative grounds).
So Formalities Chk Pass is good news, but limited news. It tells you the application is properly constituted and can move to examination. It says nothing yet about whether the mark will be accepted.

The Registry may also defer examination until a formality is met, for example a translation, instead of marking the file Fail.

The examiner searches earlier marks and tests the mark under sections 9 and 11. A clear mark is accepted; otherwise an examination report lists objections, and the status becomes Objected.

What is the time limit after Formalities Chk Pass?
There is no time limit for you at this status, because nothing is due from you. There is also no statutory time limit for the Registry to move the file to examination. How long an application stays at Formalities Chk Pass depends on the examination queue, and IP India does not publish a current figure for it.
If you need the examination sooner, for example because a marketplace or investor wants to see progress, you can request expedited examination on Form TM-M with the prescribed fee. Under rule 34 the application is then ordinarily examined within three months of the request. Expedited examination does not make acceptance more likely; it only brings the decision forward.
Stuck at Formalities Chk Pass: what can you do?
A long wait at Formalities Chk Pass is common and is not, by itself, a sign of a problem. Before assuming the worst, work through these checks:
- Read the documents tab on the e-register. A notice or examination report may have issued without the status catching up.
- Check the email address on the application. Registry correspondence goes there. If it was a former employee’s address, change it.
- Confirm the application number and class. A multi-class application shows one status for the file; separate applications each have their own.
- Decide whether speed matters. If it does, request expedited examination on Form TM-M.
- Do not refile. A second application for the same mark adds a conflicting file and a second fee, and does not move the first one.

A worked example
Illustrative only: a logo mark filed by a startup
A startup files a word-and-logo mark in class 9 at the lower fee. The file shows New Application, then Send to Vienna Codification while the logo is coded, then Formalities Chk Pass once its DPIIT recognition and the signed TM-48 are found in order. Had the recognition certificate been missing, the status would have read Formalities Chk Fail, with one month from the notice to file it or pay the difference. From Pass, the file waits for Marked for Exam.

Good. It means the paperwork is in order. It is not yet a decision on the mark: examination under sections 9 and 11 comes next.
How long does it take to go from Formalities Chk Pass to Marked for Exam?
It varies with the Registry’s workload, and there is no official figure. If you need examination within a known time, request expedited examination; rule 34 says the application is then ordinarily examined within three months.
Can I use ™ when the status is Formalities Chk Pass?
Yes. You may use ™ from the day you file. ® must wait until the status is Registered.
What happens if I do not cure a Formalities Chk Fail?
Under rule 31, if the deficiency is not remedied within one month of the notice, the application is treated as abandoned. You would then need a fresh application with a new filing date.
Does Formalities Chk Pass mean nobody else has the same mark?
No. The formalities check does not search earlier marks. The examiner does that later. A trademark search before filing is the way to find conflicts early.
Can I change my application after Formalities Chk Pass?
Some changes, such as correcting a clerical error or narrowing the goods, can be requested on Form TM-M. You cannot change the mark materially or widen the goods. Ask before filing anything.
