Patent Filing in Europe (EPO) from India
European Patent Office · European Patent Convention · Unitary Patent since 1 June 2023
A European patent is granted by the European Patent Office (EPO) after one examination in English, French or German, and can then take effect in up to 39 EPC states, either by national validation or as a Unitary Patent across the participating EU states. Indian applicants file within 12 months of priority, or enter the European phase of a PCT application at 31 months.

How does an Indian applicant get a patent in Europe?
Through the European Patent Office in most cases. The EPO is not an EU body: it serves the 39 states of the European Patent Convention, which include all EU members as well as the UK, Switzerland, Norway and Turkey.
There are two ways in:
- A direct European application filed within 12 months of the Indian priority date, claiming it. Examination starts sooner, which helps when Europe is a key market.
- Euro-PCT. A PCT application entering the European regional phase by 31 months from priority. If the EPO acted as International Searching Authority, there is usually no further European search, which saves time and fees.
From search to grant
The EPO issues an extended European search report with a written opinion. You then have six months from the publication of the search report to request examination and respond. Examination follows the EPO’s problem-solution approach to inventive step, and amendments must have a basis in the application as filed, so the original text matters more in Europe than almost anywhere else. Renewal fees are payable to the EPO from the third year while the application is pending.
After grant: validation or Unitary Patent
Once granted, a European patent becomes a bundle of national rights. Since 1 June 2023 you can also request unitary effect within one month of grant, giving one patent with uniform effect in the EU states taking part in the Unitary Patent system, enforced before the Unified Patent Court. Non-participating states, such as Spain, Poland, the UK and Switzerland, still need national validation, sometimes with translations.
For third parties, a European patent can be opposed at the EPO within nine months of grant, centrally for all states. Opposition is a real risk in crowded fields, and a strong original specification is the strongest defence.
What are the EPO deadlines from an Indian priority date?
Priority and regional phase dates are fixed; examination usually takes three to five years from filing.
| Stage | Timing | Notes |
|---|---|---|
| Indian priority filing | Month 0 | Section 39 applies to Indian residents |
| Direct European filing | By month 12 | Paris Convention priority |
| Publication | 18 months from priority | With the search report if ready |
| Euro-PCT regional phase | By month 31 | EPC r. 159 |
| Request for examination | 6 months after the search report is published | Reply to the search opinion at the same time |
| Grant | Often 3–5 years from filing | Varies by technical field |
| Unitary effect request | Within 1 month of grant | For participating EU states |
| Opposition window | 9 months from grant | Central attack at the EPO |
EPO fees and reductions are listed on the EPO fees page. Timings are indicative.
What do you need for a European patent application?
At filing or regional phase entry
- Description, claims, abstract and drawings in English, French or German
- Applicant and inventor details, and designation of inventor
- Priority claim: Indian application number and date
- Authorisation for the European patent attorney
- Proof that section 39 was satisfied for Indian-resident inventors
During prosecution and after grant
- Certified copy of the Indian priority document (or WIPO DAS code)
- Responses to the search opinion and examination reports
- Translations of the claims at grant into the other two EPO languages
- Translations for national validations where required
Europe has no general grace period
A public disclosure by the inventor before the priority date, at a trade fair, in a pitch deck shared openly or in a paper, can destroy novelty at the EPO. The USA allows one year for the inventor’s own disclosures and India allows only narrow exceptions. Keep the invention confidential until the Indian priority application is on file.
Questions about European patents from India
Is a European patent the same as an EU patent?
No. The EPO grants European patents for 39 EPC states, including non-EU states such as the UK and Switzerland. The Unitary Patent is an option after grant for the participating EU states only.
Does a European patent cover the UK after Brexit?
Yes. The UK remains an EPC state, so a European patent can be validated in the UK. The UK does not take part in the Unitary Patent.
Can I file directly at the EPO from India?
Yes, through a European patent attorney, provided section 39 is satisfied for any Indian-resident inventor. Most Indian applicants file in India first and then at the EPO or through the PCT.
Why does the EPO object to amendments so strictly?
European law forbids adding subject matter beyond the application as filed. Even small rewordings can be refused if there is no direct basis, so the original description should support fallback positions.
Are software inventions patentable at the EPO?
Programs for computers as such are excluded, but inventions that solve a technical problem with technical means, including through software, can be patented. The claims must show the technical effect.
How much does a European patent cost?
Costs come from EPO filing, search, examination and renewal fees, attorney fees, and validation or Unitary Patent renewal fees after grant. We prepare a written budget by stage; official fees are on the EPO fees page.
