What should Pune startups and manufacturers file first?
Pune's two economies, product startups and engineering manufacturers, need different first filings.
Software and SaaS companies in Hinjewadi, Kharadi and Baner usually start with class 9 (the downloadable app or software) and class 42 (the hosted service). Check the name against app stores and domain registries at the same time; a clash there is often what forces a rebrand. File in the company's name, not a founder's, so the mark is an asset of the business when investors carry out due diligence.
Auto-component and machinery makers in Chakan, Bhosari and Talegaon often supply only to vehicle makers and assume a trademark does not matter. It does once you sell to the aftermarket or export: register the house mark in class 12 for parts and class 7 for machines.
Education and coaching brands are a large Pune sector. Names like "Pune Academy" describe the place and the service and will draw an objection; a distinctive word with the place name added registers far more easily.
If you plan to sell abroad, the Indian application can serve as the basis for a Madrid Protocol filing.
How long does trademark registration take for a Pune business?
Most Pune applications are filed within a working day of approval; the rest of the timeline depends on the examiner and on whether anyone opposes.
Day 1–2
Search and class advice
We search the register for identical and similar marks, then check the name against company names on MCA and common app-store listings, which is where Pune startups most often find a clash.
Before filing
Paperwork and authorisation
An authorised director signs Form TM-48 and returns a scan. If a founder used the name before the company existed, we record that earlier date of first use in the affidavit the formalities check looks for, with the founder’s assignment to the company.
Filing day
Filing with the Trade Marks Registry, Mumbai
We file Form TM-A online on IP India. Because the principal place of business is in Maharashtra, the application is handled by the Trade Marks Registry, Mumbai. You receive the application number the same day and may use ™ with the mark.
Weeks to months
Examination
An examiner checks the mark against the absolute grounds (section 9) and earlier marks (section 11) and issues an examination report. Reports are published on the IP India status page; we watch it and tell you.
If raised
Objection reply and hearing
If the examiner cites an earlier mark or calls the name descriptive, we reply with arguments and, where it helps, evidence of use such as app downloads or invoices. Hearings at the Mumbai registry are attended by us, normally by video.
After acceptance
Journal and opposition window
An accepted mark is advertised in the Trade Marks Journal. Any person may oppose it within four months of advertisement.
Unopposed
Registration certificate
The mark is registered and the certificate is issued online. Registration lasts ten years from the application date and renews with Form TM-R.
What documents does a Pune business need?
For a Hinjewadi or Baner startup, the DPIIT recognition certificate matters most because it brings the lower fee. Chakan and Bhosari suppliers registered under Udyam send that certificate instead.
Every applicant
- The mark: the word, or a clear JPG of the logo as it will be used
- The goods or services you sell or plan to sell
- Applicant name, address and legal entity
- Form TM-48 authorising the agent, which we prepare for signature
- If the mark is already in use: an affidavit of first use in India, with dated evidence of use
By applicant type
- Individual or proprietor: identity and address proof
- Startup: DPIIT recognition certificate, for the lower fee
- Small enterprise: Udyam registration certificate, for the lower fee
- Company or LLP: certificate of incorporation
- Partnership firm: partnership deed
What are the government fees?
The government fee is charged per class. DPIIT-recognised startups and Udyam-registered MSMEs in Pune pay the lower rate on proof; other companies pay the standard rate.

Trademark registration in Pune: questions
Which Trade Marks Registry handles Pune?
The Trade Marks Registry, Mumbai. It covers every district of Maharashtra, as well as Goa, Madhya Pradesh and Chhattisgarh.
Our Baner SaaS startup sells abroad. Should we file in India first?
Usually yes. An Indian application gives you a priority date and can be the base for a Madrid filing covering other countries. Under the Paris Convention you have six months from the Indian filing to claim that priority abroad.
Will investors ask about our trademark before funding?
Often. Due diligence checks who owns the brand and whether it is registered or pending. A pending application in the company’s name answers most of those questions.
A Chakan supplier sells only to vehicle makers. Does it need a trademark?
If every part carries the buyer’s brand, the need is limited today. Once you sell spares to the aftermarket, export or bid on your own name, register the house mark in class 12 or class 7.
Can a Pune coaching institute register a name like "Pune Academy"?
Not as it stands: it describes the place and the service. Add a distinctive word or logo, and expect the examiner to ask you to disclaim the descriptive part.
Should the founder or the company own the trademark?
Whoever uses the mark in trade should own it, which is usually the company. If a founder already filed, the mark can be assigned to the company later with Form TM-P.
Do I need to travel to Mumbai for a hearing?
No. We attend show-cause hearings for you, usually by video conference, and send a note of the outcome.
