Where do Mumbai’s patent applications come from, and what can be patented?
Mumbai's applications come mainly from four places: research institutions such as IIT Bombay in Powai and the Institute of Chemical Technology in Matunga; pharmaceutical and chemical companies with laboratories in the city and along the Thane–Belapur belt; engineering and electronics manufacturers; and software and fintech companies.
Indian patent law draws two lines that matter for these sectors.
- Software. A computer programme "per se" is not an invention under section 3(k). An invention implemented in software can still be patented when it solves a technical problem with a technical effect, for example in how a device or network operates. The specification must be drafted around that effect.
- Pharmaceuticals. Under section 3(d), a new form of a known substance, such as a salt, polymorph or ester, is not patentable unless it shows significantly enhanced efficacy. Data supporting efficacy belongs in the specification or must be available at examination.
Every invention must also be new, involve an inventive step and be capable of industrial application. A patentability search before drafting tells you how much room there is. Inventors across the creek in Turbhe, Mahape or Kharghar can meet us at our Vashi office: see patent filing in Navi Mumbai.
How does patent registration work for a Mumbai applicant?
Before drafting
Patentability search
We search patent and non-patent literature for the closest prior art and give a written view on novelty and inventive step. See patentability search.
Day 0
Provisional specification (optional)
Form 1 with a provisional specification on Form 2 fixes the priority date. The complete specification must follow within 12 months. See provisional applications.
Within 12 months
Complete specification and forms
The complete specification with claims is filed with Form 3 (foreign filings), Form 5 (inventorship) and Form 26 (agent’s authorisation), at the Patent Office, Mumbai branch.
18 months
Publication
The application is published in the Patent Office Journal 18 months from the priority date, or earlier if you request early publication on Form 9.
Within 31 months
Request for examination
Form 18 must be filed within 31 months of the priority date for applications filed on or after 15 March 2024 (48 months for older ones). Eligible applicants can ask for expedited examination on Form 18A.
After examination
First examination report and reply
The examiner issues a first examination report (FER). We reply with arguments and amended claims within the time allowed, and attend any hearing, which can be held by video conference. See FER reply.
Grant
Grant and renewals
Once objections are met the patent is granted. It lasts 20 years from the filing date, kept in force by annual renewal fees from the third year.
Do Mumbai startups and institutions pay less?
Yes. Patent fees are lower for natural persons, startups, small entities and educational institutions than for other applicants, often by a wide margin. A recognised startup or a small entity files proof of status with the application.
Some applicants can also ask for expedited examination: startups, small entities, female applicants and certain government institutions among them. Expedited examination can shorten the time to a first examination report considerably, but it carries a higher fee and tighter reply deadlines.
Institutions such as colleges in Mumbai should settle ownership before filing: whether the institution, the researchers or a sponsor owns the invention depends on employment terms and research agreements.
What are the government fees for a patent?
Official fees under the Patents Rules, 2003, by applicant type. Our professional fee is quoted separately, in writing.

Patent registration in Mumbai: questions
Where is the Patent Office in Mumbai?
At Boudhik Sampada Bhavan, near Antop Hill Post Office, S.M. Road, Antop Hill, Mumbai 400037. Applications and replies are filed online, so visits are rarely needed.
Can a Mumbai company file at the Delhi or Chennai patent office instead?
Not by choice. The appropriate office follows the applicant’s residence or place of business, or where the invention originated. A Mumbai company files in Mumbai.
Is software patentable in India?
A computer programme as such is not. An invention that uses software to achieve a technical effect can be, if the claims are drafted around that effect.
Can a new salt or polymorph of a known drug be patented?
Only if it shows significantly enhanced efficacy over the known substance, under section 3(d). Plan the supporting data before you file.
Should I file a provisional application first?
If the invention is still developing, yes: it fixes the priority date cheaply. You then have 12 months to file the complete specification.
Do I have to attend a hearing at Antop Hill?
No. Hearings can be held by video conference, and your patent agent attends. You may join if you wish.
How long does a patent last in India?
Twenty years from the filing date of the application, provided the renewal fees are paid each year from the third year.
