What should Jabalpur’s garment and stone businesses register?
Readymade garments. Many Jabalpur units sell through wholesalers who resell across central India, sometimes under the unit's label and sometimes under none. A label that buyers ask for by name is worth registering in class 25; without it, a wholesaler can switch to a copy and you have little to stop them. If you also sell wholesale under the same name, add class 35.
Marble and stone. Tiles, slabs and carved marble from Bhedaghat and the Katni quarries are class 19. A trademark protects the name and logo on the box or the shop; it does not protect the shape of a carved piece. A new, original shape can be protected by design registration, which is a separate filing.
Peas and produce. Fresh green peas packed for other states are class 31; frozen peas are class 29. A packer that sells both needs both classes.
Engineering and defence suppliers in Richhai and Adhartal often make parts to a buyer's drawing. When you start selling under your own name, register it in class 7 for machine parts or class 12 for vehicle parts.
How does a Jabalpur business register a trademark?
Day 1–2
Search and class advice
We search the name and the label artwork in class 25 or 19, where garment and stone marks are crowded, and tell you which elements are free to use and which are taken.
Before filing
Paperwork and authorisation
We email Form TM-48; the proprietor or a partner signs it and returns a scan. We confirm the goods description, class 25 or 19, against your invoices before filing.
Filing day
Filing with the Trade Marks Registry, Mumbai
We file Form TM-A online on IP India. Because the principal place of business is in Madhya Pradesh, the application is handled by the Trade Marks Registry, Mumbai. You receive the application number the same day and may use ™ with the mark.
Weeks to months
Examination
An examiner checks the mark against the absolute grounds (section 9) and earlier marks (section 11) and issues an examination report. Reports are published on the IP India status page; we watch it and tell you.
If raised
Objection reply and hearing
If the examiner objects, we answer in writing with your evidence of sales. Show-cause hearings are attended by us, usually by video conference.
After acceptance
Journal and opposition window
An accepted mark is advertised in the Trade Marks Journal. Any person may oppose it within four months of advertisement.
Unopposed
Registration certificate
The mark is registered and the certificate is issued online. Registration lasts ten years from the application date and renews with Form TM-R.
What documents does a Jabalpur business need?
Garment units that sell only through wholesalers should keep a dated wholesale invoice showing the label, which proves use in trade. Marble and stone businesses run by families as partnerships send the deed.
Every applicant
- The mark: the word, or a clear JPG of the logo as it will be used
- The goods or services you sell or plan to sell
- Applicant name, address and legal entity
- Form TM-48 authorising the agent, which we prepare for signature
- If the mark is already in use: an affidavit of first use in India, with dated evidence of use
By applicant type
- Individual or proprietor: identity and address proof
- Startup: DPIIT recognition certificate, for the lower fee
- Small enterprise: Udyam registration certificate, for the lower fee
- Company or LLP: certificate of incorporation
- Partnership firm: partnership deed

Trademark registration in Jabalpur: questions
Which registry handles Jabalpur and Katni?
The Trade Marks Registry, Mumbai. Both are in Madhya Pradesh.
Is there a trade marks office nearer to Jabalpur than Mumbai?
Distance does not matter: the office is fixed by the state. Madhya Pradesh is assigned to Mumbai, and filing is online either way.
Our garment unit sells to wholesalers without a brand. Is it worth registering one?
If you want buyers to ask for your goods by name, yes. A registered label in class 25 lets you act against copies in the wholesale market.
Are fresh and frozen peas in the same class?
No. Fresh peas are class 31 and frozen peas class 29. File in both if one brand covers both.
Can a Bhedaghat carver protect the shape of a marble piece with a trademark?
Generally not. A trademark protects the name and logo. An original shape is protected by design registration under the Designs Act.
Can a defence supplier in Richhai register its own name?
Yes. Choose the class by what you make: class 7 for machine parts, class 12 for vehicle parts. It matters most once you sell outside contract work.
