Dairy and edible oils, snacks and staples, and the shop or online store.
For namkeen makers, oil processors, Pithampur manufacturers and Indore’s service businesses.
Indore applications are examined by the Trade Marks Registry, Mumbai, not Delhi: the Mumbai office covers Madhya Pradesh along with Maharashtra, Goa and Chhattisgarh. We file online from Vashi and handle any objection. If there is no objection or opposition, registration commonly takes about a year.
The Trade Marks Registry, Mumbai. Many Indore businesses expect Delhi, but Madhya Pradesh is one of the four states under the Mumbai office, so Indore, Pithampur, Dewas and Ujjain are all examined there.

Examination, objections and hearings
No visit to the office is needed. Hearings can be attended by video, and we attend for you.
Namkeen and snacks. Gram-flour namkeen, sev and mixtures are class 30, but potato chips and wafers are class 29. A namkeen maker that also sells chips under the same brand needs both classes. "Indori" in a brand describes origin and will need a distinctive partner word; "Ratlami Sev" is a geographical indication of Ratlam and cannot be anyone's trademark.
Soybean and edible oils. Refined soybean oil is class 29. Soybean meal sold as animal feed is class 31. Processors that sell both should file both.
Pithampur pharmaceuticals. Medicine names are judged more strictly than other goods, because confusion between two drugs can harm patients. Indian courts apply a stricter test of similarity to medicinal products, so a name that is one or two letters away from an existing drug is risky even in a different therapeutic area. We search class 5 with that standard in mind.
Pithampur auto and engineering units register the house mark in class 12 for vehicles and parts, or class 7 for machines.
Education and IT along the Super Corridor and Vijay Nagar file in classes 41 and 42.
Snack and edible-oil brands, the Pithampur drug makers, readymade garments and the coaching institutes, with their usual classes.
Class 29Class 30Class 35
Dairy and edible oils, snacks and staples, and the shop or online store.
Starting points only: the right classes depend on exactly what you sell. See the 45 trademark classes or search them in the class finder.
Day 1–2
We search the register in the classes you sell in, including Hindi spellings of the name where you use them on packs. For class 5 we apply the stricter medicine standard and flag near-identical drug names.
Before filing
We email Form TM-48 for signature and return. For a namkeen or oil brand already on shelves, the oldest dated invoice fixes the claimed date of first use.
Filing day
We file Form TM-A online on IP India. Because the principal place of business is in Madhya Pradesh, the application is handled by the Trade Marks Registry, Mumbai. You receive the application number the same day and may use ™ with the mark.
Weeks to months
An examiner checks the mark against the absolute grounds (section 9) and earlier marks (section 11) and issues an examination report. Reports are published on the IP India status page; we watch it and tell you.
If raised
Objections from the Mumbai registry are answered in writing, with evidence of sales across Madhya Pradesh where it helps. Show-cause hearings are attended by us, usually by video conference.
After acceptance
An accepted mark is advertised in the Trade Marks Journal. Any person may oppose it within four months of advertisement.
Unopposed
The mark is registered and the certificate is issued online. Registration lasts ten years from the application date and renews with Form TM-R.
Madhya Pradesh has no Trade Marks Registry office of its own; it is in the Mumbai head office’s territory, with Chhattisgarh, Goa and Maharashtra. Show cause hearings may be held by video conference (rule 115), so Indore applicants are heard without travelling.
Indore, Madhya Pradesh is handled by the Trade Marks Registry, Mumbai.

Pithampur pharma companies also send the drug name, composition and date of first sale; the drug manufacturing licence is a separate approval and is not filed with the trademark. Namkeen makers who print a Hindi spelling on packs send that artwork too.
The fee is paid to IP India per class. Namkeen makers, traders and startups registered as MSMEs on Udyam pay the lower rate; other companies and LLPs pay the standard rate.

Because IP India assigns Madhya Pradesh to the Trade Marks Registry, Mumbai, together with Maharashtra, Goa and Chhattisgarh. The Delhi office handles the northern states.
Gram-flour namkeen and sev are class 30. Potato chips and wafers are class 29. If one brand covers both, file in both classes.
You may use them to describe the product truthfully, but you cannot own them. "Ratlami Sev" is a geographical indication. Build the brand on a distinctive word.
Because confusion between medicines can harm patients, courts apply a stricter test of similarity to class 5 marks. Small spelling differences are rarely enough.
Class 31, which includes animal feed. Soybean oil for cooking is class 29.
Yes. They are in Madhya Pradesh, so their applications also go to the Mumbai registry and are filed the same way.
