What are the official design registration, renewal and restoration fees?
The 2021 amendment replaced the whole First Schedule and put natural persons, startups and small entities on one lower rate. These are the fees most applicants meet over the life of a design.
| Government fee | Natural person, startup or small entity | All other applicants |
|---|---|---|
| Application for registration of a design (sections 5 and 44)Form 1per application | ₹1,000 | ₹4,000 |
| Extension of the period of copyright by five years (section 11(2))Form 3per design, before the first 10 years end | ₹2,000 | ₹8,000 |
| Restoration of a lapsed design (section 12)Form 4per design, within one year of lapse | ₹1,000 | ₹4,000 |
| Additional fee for restoration (entry 5)Form 4per design, with the unpaid extension fee | ₹1,000 | ₹4,000 |
Government fees from Designs Rules, 2001, First Schedule, as substituted on 25 Jan 2021 (IP India), as checked on . Statutory fees only; the firm's professional fee is quoted separately in writing.
A design has no recurring renewal. The one extension, on Form 3, takes the term from 10 to 15 years, and is the fee people usually mean by "design renewal".
When are the design extension and restoration fees due?
| Stage | Time limit | Form and fee | Source |
|---|---|---|---|
| Registration | Protection runs 10 years from the date of registration | Form 1 with the application fee | Section 11(1) |
| Extension ("renewal") to 15 years | Application made before the first 10 years end | Form 3 with the extension fee; the extra 5 years run from the end of year 10 | Section 11(2) |
| Lapse | If the extension fee is not paid before year 10 ends | The design ceases to have effect | Section 12(1) |
| Restoration | Within one year from the date the design ceased to have effect | Form 4 with the restoration fee, a verified statement of why the fee was missed, then the unpaid extension fee and the additional fee | Sections 12 and 13 |
| After one year | More than one year after lapse | No restoration; the design is open to others | Section 12(1) |
The Controller restores a design only if satisfied that the failure to pay was unintentional and that there was no undue delay in applying (section 13(1)).
What does a design cost in government fees over its life?
Worked examples using the First Schedule amounts above. They exclude professional fees.

|---|---|---|
| Startup, one design, full 15 years | ₹1,000 (Form 1) + ₹2,000 (Form 3) | ₹3,000 |
| Company, one design, full 15 years | ₹4,000 + ₹8,000 | ₹12,000 |
| Furniture maker (small entity), three chair designs, 10 years | 3 × ₹1,000 | ₹3,000 |
| Company restoring a lapsed design within the year | ₹4,000 (Form 4) + ₹8,000 (unpaid extension) + ₹4,000 (additional fee) | ₹16,000 |
Fees from the Designs Rules, 2001, First Schedule, as substituted by G.S.R. 45(E) of 25 January 2021, entries 1, 3, 4 and 5, checked on 15 October 2026. Statutory fees only; our professional fee is quoted separately in writing.
Which design fees does an applicant pay, and when?
| Fee | When it is paid | Who pays the lower rate |
|---|---|---|
| Application for registration (Form 1) | On filing, for each design in each class | Natural persons, startups and small entities |
| Extension of the term by 5 years (Form 3) | Before the first 10 years end | Natural persons, startups and small entities |
| Restoration of a lapsed design (Form 4) | Within 1 year of lapse, with the unpaid extension fee | Natural persons, startups and small entities |
| Other requests | As they arise, for example amendments, certified copies or recording a new owner | As the schedule provides |
The amounts are in the fee table above. The 2021 amendment introduced the startup category and placed small entities in the lower tier.
Who qualifies for the lower design fee?
The lower tier in the First Schedule covers three kinds of applicant:
- Natural persons, applying in their own names.
- Startups, recognised under the Startup India initiative, or a foreign entity meeting the equivalent criteria.
- Small entities, enterprises within the small-enterprise limits under the MSME law.
Startups and small entities file Form 24 with proof of status, such as the DPIIT recognition certificate or the Udyam registration, along with the application. If one of several applicants is not in the lower tier, confirm the applicable fee before filing.
How do design fees add up for several products?
The application fee applies to each design in each class. A furniture maker registering three different chair designs pays three application fees; a single bottle design applied to articles in two Locarno classes pays for two classes. Variants of one design are usually filed as separate designs when each has its own new features, so the number of designs, not the number of products, drives the cost.
Plan the extension too. Every registered design needs a Form 3 extension fee before its tenth year ends if you want the full 15 years of protection.
Design fee FAQs
Is the design fee charged per design or per application?
For each design in each class. Several designs or classes mean several fees, even when filed together.
Do startups pay less for design registration?
Yes. Since the 2021 amendment to the Designs Rules, startups pay the lower tier with natural persons and small entities, on proof filed with Form 24.
Is there a renewal fee for designs?
There is one extension, not a recurring renewal: a Form 3 fee of ₹2,000 (natural persons, startups, small entities) or ₹8,000 (others) extends protection from 10 to 15 years, and it must be paid before the first 10 years end.
What does it cost to restore a lapsed design?
A restoration application on Form 4 within one year of lapse (₹1,000 or ₹4,000), then the unpaid extension fee and an additional restoration fee of the same amount as the Form 4 fee. For a company that is ₹16,000 in all.
Is the design fee refunded if the application is refused?
Generally no. The fee pays for processing and examination. A careful novelty check before filing is the surest way to avoid paying for an application that cannot succeed.
Is GST charged on design government fees?
The statutory fee is paid to the Patent Office as set in the schedule. GST applies to professional fees, not to the government fee.
