Wine is class 33. Most wineries need three layers of protection, filed in this order:
Grape varieties such as Shiraz, Sauvignon Blanc or Chenin Blanc are generic and cannot be registered by anyone. Nor can a winery claim the region's name for itself: "Nashik Valley Wine" is a geographical indication for qualifying producers. Build the brand on a word that is yours.
Two practical points. Label approval from the state excise department is a separate requirement, and a registered trademark does not replace it. And if you export, plan the foreign filings early: the Indian application can support a Madrid filing within six months while keeping your Indian priority date.
Grape and onion exporters around Pimpalgaon Baswant and Lasalgaon register packer marks for fresh produce in class 31. Engineering units in Satpur and Ambad file in classes 7, 9 or 12 depending on what they make, and Malegaon powerloom traders in class 24.
Grape and onion growers who pack under a brand, the Malegaon powerlooms, and the hotels and eateries that serve pilgrims. Wine (class 33) and fresh produce (class 31) fall outside these tiles.
Class 29Class 30Class 35
Dairy and edible oils, snacks and staples, and the shop or online store.
Class 43
Food service; packaged sauces or snacks sold under the brand add Class 29 or 30.
Starting points only: the right classes depend on exactly what you sell. See the 45 trademark classes or search them in the class finder.
Day 1–2
We search the register in your class and in neighbouring ones; for wineries that means class 33 and class 32, because beer and wine marks can conflict. You receive a written risk report before anything is filed.
Before filing
We send Form TM-48 for signature by scan. Where a label sold before filing, the earliest dated invoice or packing slip fixes the claimed date of first use.
Filing day
We file Form TM-A online on IP India. Because the principal place of business is in Maharashtra, the application is handled by the Trade Marks Registry, Mumbai. You receive the application number the same day and may use ™ with the mark.
Weeks to months
An examiner checks the mark against the absolute grounds (section 9) and earlier marks (section 11) and issues an examination report. Reports are published on the IP India status page; we watch it and tell you.
If raised
If the examiner says the name describes the wine or the region, we reply with arguments and evidence of use. Hearings are attended by us, normally by video, so you stay at the vineyard.
After acceptance
An accepted mark is advertised in the Trade Marks Journal. Any person may oppose it within four months of advertisement.
Unopposed
The mark is registered and the certificate is issued online. Registration lasts ten years from the application date and renews with Form TM-R.
Nashik district borders Gujarat, but the Ahmedabad office plays no part: a Nashik business is examined by the Mumbai head office. Its hearings may be held by video conference (rule 115).

Wineries send the final label as printed, since it is filed as a device mark; the excise label approval is a separate permission and is not part of the trademark file. Grape and onion packers send a dated packing slip showing the packer mark.
Fees are paid to IP India for each class. Most Nashik wineries and growers that are Udyam-registered MSMEs qualify for the lower rate; larger companies pay the standard rate.

No. Variety names are generic for wine and stay free for every producer. Register the estate or label name and show the variety beside it.
No. Excise label approval is a separate regulatory step. A trademark protects the brand; it does not authorise the sale of liquor.
Only if your wine qualifies under the geographical indication and you use it as the GI rules allow. You cannot register it as your own trademark.
Class 31 for fresh fruit. Buyers abroad may also expect your mark to be protected in their country, which is a separate filing.
Class 9 covers electrical switchgear and controls. Mechanical parts for machines fall in class 7. We check the exact goods against the class headings before filing.
No. Our office is in Vashi; Nashik clients send documents by email and talk to us on video calls. Visits are welcome by appointment.
