A registered mark also gives you the legal footing to act against counterfeit packs, a real problem for lubricant and food brands. Without objection or opposition, registration commonly takes about a year.

Lubricants and industrial oils (class 4) are blended and traded near the Mahul refineries, and counterfeit packs of known brands are common in the trade. Register the name and the container label as a device mark. A registered mark lets you sue for infringement, and falsely applying a trademark is also a criminal offence under the Trade Marks Act, so police complaints become possible.
Chemical and fertiliser traders (class 1) register their house mark on bags and drums; the chemical names themselves stay free.
Sindhi food businesses in Chembur Camp sell papad, sweets and farsan (class 30). "Sindhi Papad" describes the product and its community origin and cannot be one maker's brand; a family or coined name can.
Restaurants (class 43) sometimes find that another outlet in the city has used the same name for years. Honest concurrent use can allow both to be registered, but it needs evidence, so keep old menus and bills.
Builders redeveloping housing societies should not register the society's old name for their project without the society's written consent; the name belongs to the society.
Papad, sweet and farsan makers, the restaurants, and the builders redeveloping housing societies. Lubricants (class 4) and chemicals (class 1) are covered above.
Class 29Class 30Class 35
Dairy and edible oils, snacks and staples, and the shop or online store.
Class 43
Food service; packaged sauces or snacks sold under the brand add Class 29 or 30.
Starting points only: the right classes depend on exactly what you sell. See the 45 trademark classes or search them in the class finder.
Day 1–2
We search the name and the label in class 4 for lubricants, class 1 for chemicals or class 30 for papad and farsan, and note look-alike labels already on the register. The written report flags the features counterfeiters are likely to copy.
Before filing
Send the container or pack label exactly as printed, and the proprietor’s ID or the firm’s documents. A restaurant claiming years of use keeps its old menus and bills for the affidavit. Form TM-48 can be signed at our Vashi office, across the creek.
Filing day
We file Form TM-A online, with the word and the label as separate applications where both matter. Each application number is issued the same day.
After filing
The examiner reviews the mark and we answer any objection. After acceptance it is advertised in the Trade Marks Journal, where anyone has four months to oppose. An unopposed mark is registered for ten years from the application date, and can then be enforced against fake packs.
Chembur, Trombay and Mankhurd lie between Antop Hill and our office across the creek, and all file with the Mumbai head office. A show cause hearing may be held by video conference (rule 115).
