Can a Kolhapuri chappal maker register a brand?

Yes, a maker can register its own brand, but not the word "Kolhapuri". Kolhapuri chappals are protected as a geographical indication, which belongs to qualifying producers of the region together. Your trademark has to distinguish your chappals from every other maker's: a workshop name, a family name with a logo, or a coined word, in class 25 for footwear and class 18 if you also make leather bags and belts.

The same logic applies to Kolhapur jaggery. The place name tells buyers where it comes from; your mark tells them who made it. File the brand on the block or the pouch in class 30.

Where many small makers share one tradition, a collective mark can help. An association of Hupari silversmiths, or a footwear makers' co-operative, can register a collective mark under the Trade Marks Act that its members use alongside their own brands. It is a separate application with rules of use filed with it.

The district's industry needs simpler filings. Foundries in Shiroli and Gokul Shirgaon register the house mark cast or stamped on parts, in class 7 for machine and engine parts or class 12 for vehicle parts. Dairies file in class 29.
